- Applicant must be a national of a country with which the U.S. maintains a treaty of commerce and navigation; must have invested, or be actively investing, a substantial amount of capital in a bona fide U.S. enterprise; and must seek entry solely to develop and direct the enterprise. Treaty national founder must retain meaningful ownership and operational control.
